The petitioner has filed the instant application under Section 439 CrPC seeking interim bail on the ground of illness of his mother, who is suffering from uretic calculus and has been advised surgery which is scheduled for 15th November, 2017.

Status report on behalf of the State has been filed which is to the following effect:- ".......... applicant has now sought interim bail on the ground that his mother Smt.Kanta is diagnosed to be suffering from uretic calculus with Hydronephrosis and has been advised surgery on 15.11.2017 and is scheduled to be admitted in hospital on 13.11.2017. The application for grant of interim bail of applicant Vasu Sharma @ Bunty was verified. The certificate issued by the Nursing Home annexed with the interim bail was verified from R.N.Khetrapal Memorial BAIL APPLN. 2212/2017

Nursing Home, Vishnu Garden, Khyala Road, New Delhi. Smt.Kanta is being treated by Dr.S.K.Khetrapal at the Nursing Home.

The facts about the family of applicant were verified from the given address of the applicant at Jahangirpuri. Sh.Shiv Ram, the father of the applicant has expired many years back and his mother Smt.Kanta has vacated the place in Jahangirpuri. The family has sold half of the land to Sh.Pawan Gupta and rented half of the remaining portion to a building material dealer. Smt.Kanta is now living at their native place Dadri, U.P. Statement of Sh.Pawan Gupta has been recorded in this regard. Applicant has a sister Mamta who is married and is living in U.P. His grandmother Smt.Anguri and uncle Vishnu also live in Jahangirpuri who can look after his mother Smt.Kanta during the hospitalization period." 3.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

The application is dismissed as withdrawn.
