% 20.12.2018 The matter has been taken up in terms of an office note in view of receipt of a letter dated 30.11.2018 from the learned ADJ-14, Central as sent to the Registrar General of this Court pursuant to proceedings dated 07.11.2017 whereby the learned Executing Court had been directed to inform the Registry of this Court immediately for the re-listing of the petition and for an action to be taken against the petitioner/JD for breach of undertaking given to this Court in terms of order dated 07.11.2017 in the event of the same being breached. The report as received from the learned ADJ-14, Central indicates that though the petitioner herein did put in appearance before the learned Executing Court on the date 08.12.2017 and handed over three cheques bearing nos.321539, 321540 & 321537 dated 08.12.2017, 08.12.2017 & 09.12.2017 respectively for a sum of Rs.9 lakhs, Rs.1,64,671/- & Rs.1.50 lakhs to the decree holder but all these three cheques were dishonoured and that thus, the judgment
debtor had failed to comply with the undertaking given to this Court. In terms of order dated 07.11.2017, it has already been directed that if the petitioner/JD failed to pay the entire decretal amount, the Executing Court would be entitled to proceed in accordance with law and thus the learned Executing Court is directed to proceed as directed thereby.
In view of the reported breach of undertaking given by this Court in terms of order dated 07.11.2017, the matter subject to the orders of the Hon'ble The Chief Justice be placed before Hon'ble Roster Bench dealing with Civil Contempt Cases. ANU MALHOTRA, J DECEMBER 20, 2018/NC
