% 15.11.2017 This order is in continuation of the last order. Learned counsel for first respondent clarifies that violation is of the provisions of Rule 98 (1) of the Delhi School Education Act and Rules, 1973 and in this regard, first respondent has issued a Corrigendum of 13th November, 2017. It is pointed out by learned counsel for first respondent that Communication of 28th September, 2017 (Annexure P-2) from first respondent to petitioner is in fact a reply to her Representation and is not an order. It is submitted that on 14th November, 2017, first respondent has sought for the comments from respondent No.2-Chairman/Managing Committee of School in question and so, this petition is premature. Learned counsel for respondent No.2 submits that the comments on first respondent's letter of 1st November, 2017 shall be positively furnished within a week from today.

Upon receiving the comments from second respondent, first respondent shall take a decision within three weeks on petitioner's appointment on the post of Assistant Teacher (UR) and if first respondent chooses not to grant approval to appointment of petitioner on the post of Assistant Teacher (UR), then reasons for not doing so shall be indicated by first respondent to petitioner so that petitioner may avail of the remedies as available in law, if need be.
Learned counsel for respondent No.2, on instructions, submits that petitioner can join her duties purely on Ad-hoc basis from tomorrow i.e. 16th November, 2017 till the decision is taken by first respondent in light of this order. Let it be so done.
With aforesaid directions, this petition is disposed of as premature. Dasti.
