% 12.12.2017 Status report submitted by the State.
As per the said status report it has been submitted that the prosecutrix is indicated to have lodged a missing report of the applicant on 13.8.2017 in which she stated that the applicant/her husband was missing. On behalf of the applicant it has been contended that allegations levelled against the applicant of the alleged commission of rape are false and fabricated. Even as per the missing complaint lodged by the complainant/prosecutrix she had given her version to the effect that on 07.08.2017 the applicant had forced her to board a bus.
Without any observations on the merits or demerits of the case, in view of the averments made in the FIR and the statement under section 164 of Cr.PC, 1973 of the prosecutrix coupled with the missing complaint which she has lodged about the applicant, with no
averment in the FIR and the statement under Section 164 of the Cr.PC, 1973 of the missing complaint of the applicant lodged by her claiming him to be her husband and as in reply to a specific Court query, the Investigating Officer has stated that there are no previous adverse antecedents against the applicant, the applicant is allowed to be released on bail on his furnishing a bail bond of Rs. 50,000/- with one surety to the satisfaction of the learned trial Court subject to the conditions that he shall not tamper with the evidence in any manner, shall not intimidate the witnesses, shall not contact the complainant and shall not leave the country.
