O R D E R

% 31.05.2018 Present suit has been filed for permanent injunction restraining infringement of trademarks, passing off, dilution, infringement of copyright, rendition of accounts, damages, delivery up. Learned counsel for the defendant, on instructions of Mr.Dinesh Garg, an authorised representative of the defendantcompany, states that the defendant has no objection if the present suit is decreed in accordance with the prayers (a), (b), (c) and (e) of the plaint. He further states that the defendant shall pay costs of Rs.1,50,000/- to the plaintiff. He, however, states that out of the said sum, Rs.1,00,000/- shall be paid within two weeks and the balance amount of Rs.50,000/- shall be paid within two months

The statement made by learned counsel for the defendant is accepted by this Court and the defendant is held bound by the same. In view of the aforesaid statement, learned counsel for the plaintiff, on instructions of Ms.Anu Sharma, an authorised representative of the plaintiff-company, states that the plaintiff does not wish to press for any other relief in the present suit. Consequently, the present suit is decreed in accordance with the prayers (a), (b), (c) and (e) of the plaint along with the costs of Rs.1,50,000/- to be paid in two installments as mentioned hereinabove. Registry is directed to prepare a decree sheet accordingly.

Registry of this Court is also directed to issue to the plaintiff a certificate authorizing it to receive back from the Collector the full amount of the Court fee paid by it in the present suit. MANMOHAN, J MAY 31, 2018 KA
