Counsel for the petitioner submits that the order passed is contrary to law and judgement of the Delhi High Court dated 26th October, 2017 passed in Writ Petition (C) No. 2106/2017, Arise India Limited versus Commissioner of Trade and Taxes Delhi.

It is open to the petitioner to challenge the order passed by the respondent in accordance with law. We clarify that we have not expressed any opinion on merits. The writ petition is disposed of with liberty to the petitioner as noted above.
