% 13.11.2017 This petition under Section 27 of the Arbitration and Conciliation Act, 1996 has been filed by the petitioner seeking assistance of this Court in summoning of witnesses i.e. Officer concerned from the office of M/s IREO Private Limited having its office at 5th Floor, Orchid Centre, Golf Course Road, Sector-53 Gurgaon-122002, Haryana.

Respondents in spite of service of advance notice has not appeared. From a perusal of the order dated 4th September, 2017 passed by the Sole Arbitrator in the Arbitration case between Tarun Kaushik & Anr. vs. Kanwar Bahadur Chawla & Ors. It is apparent that the learned Arbitrator had allowed the summoning of the above witness and has fixed the next date of hearing as 7th December, 2017. In view of the above, let summons be issued to the above mentioned witness for his appearance before the Sole Arbitrator at 5:00 PM at Niti Bagh Club, Niti Bagh, New Delhi-110049 with the

entire record pertaining to Flat No.0402, in West Wing Tower of the Main Arch admeasuring 2427 Sq.Ft. on 4th Floor in Multi Storey Building Complex namely, IREO GRAND ARCH, situated at Golf Course Extension Road, Sector-58, Gurgaon, (presently occupied by the Respondents) from the date of booking of the Flat along with the payment schedule of the company for the said flat and the schedule of payments made by the allottees namely Mr. Kanwar Bahadur Chawla and Ms. Ekta Chawla from the date of booking of the flat till the date of taking over possession of the said flat. The diet money for the said witness shall be paid by the petitioner on his appearance before the Sole Arbitrator.

The Petition is disposed of in the above terms. Dasti.
