Mr. Harish Kumar Garg, who, appears for the respondent says that without prejudice to the rights and contentions of the respondent qua the merits of the case, he has instructions to convey to the Court that respondent would have no objection to this Court directing appointment of an Arbitrator.

Accordingly, the petition is disposed of with a direction that Delhi International Arbitration Centre (DIAC) will appoint an arbitrator in the matter.

The arbitration will be conducted as per the rules and fee schedule prescribed by the DIAC.

Needless to say, the respondent will have liberty to lodge a counter claim, if it chooses to do so.
