O R D E R

% 27.11.2017 The status report has been submitted on behalf of the State. On behalf of the State it has been submitted that the applicant is in custody since 03.08.2017, and he is a young man about 20 years of age and stated that he is falsely implicated in the case.

It has also been submitted on behalf of the applicant that the two other co-accused in the instant case are on bail and one other accused is absconding qua whom the proceedings under Section 82 of Cr.P.C have been initiated. It has also further been submitted on behalf of the applicant that the applicant is no longer required for any custodial interrogation. On behalf of the State, the learned APP has submitted that the chargesheet has already been filed and stated that no further investigation is required against the petitioner.

It has further been submitted on behalf of the State that the complainant was attacked with a pointed weapon and grievous injury has been sustained by the complainant.

In reply, to a specific query made by the court, it is further submitted that there are no previous adverse antecedents against the applicant. Taking into account the factum that two other co-accused in this case are on bail and that the applicant is a young man, aged about 20 years and there are no previous antecedents against him and that the investigation is complete and that he is in custody since 03.08.2017, no useful purpose would be served in keeping the appellant in custody. The applicant is allowed to be released on bail on his furnishing bond in the sum of Rs. 50,000/- with two sureties of like amount to the satisfaction of the learned Trial Court subject to the conditions that he shall not leave the city and shall not tamper with the evidence and shall not commit any offence whatsoever.
