The petitioner, by this petition, impugns order dated 05.09.2017, passed in Misc. No.1/2017, whereby, the Appellate Court, on the appeal of the respondent, had issued notice to the respondent Rakesh Kumar Jain, i.e. the petitioner in this petition. 2.
Learned counsel appearing for the respondents informs that the said case already stands disposed of by order dated 07.02.2018. He submits that the present petition has, accordingly, become infructuous.

None appears for the petitioner.
None was present for the petitioner even on 15.12.2017.

In view of the above, the petition is dismissed as infructuous CRL.M.C. 4567/2017
and for non-prosecution.
