Dhamdeep Singh, Special Power of Attorney holder of respondent no. 2 Mr. Satya Priya is present in Court and has been identified by Inspector Raj Kumar Singh of EOW Cell. It is submitted that petitioners and respondent no. 2 have settled their disputes amicably, inasmuch as settled amount of `7,85,628/- has been paid by the petitioners to respondent no. 2.
Settlement Deed dated 27th July, 2017 executed between the
respondent no. 2 and M/s. Earth Infrastructures Ltd. is on record. Petitioners were Directors of M/s. Earth Infrastructures Ltd. Affidavit of Attorney of respondent no. 2 has also been placed on record at pages 20-21. Mr.
Dhamdeep Singh says that he has instructions from respondent no. 2 to convey the Court that respondent no. 2 has no objection in case FIR No. 162/2016 under Section 420 IPC registered at Police Station Barakhamba Road and consequent proceedings emanating therefrom are quashed. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed. Petitioner nos. 1, 3 and 4 are stated to be in jail. They be released forthwith, if not required in any other case. Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
