CRL.A. 1036/2015 The petitioner is aggrieved by the order dated 27.8.2015 whereby his petition preferred under Section 340 read with Section 195 (1) (b) of the Cr.P.C. was dismissed on the ground that the petition was not worded properly and the allegations were vague. The Trial Court has also noted that the petition was not signed by the applicant or his counsel. Learned counsel for the petitioner is permitted to withdraw this petition of appeal under Section 341 of the Cr.P.C. in order to enable him to prefer a fresh, properly worded and signed petition before the Trial Court. On filing of such petition before the Court below, the same shall be

entertained on its own merits and without any prejudice that the present petition of appeal has not been entertained.
