W.P.(CRL) 3122/2017 The learned counsel appearing on behalf of the petitioner submits that the case against the accused have been registered under sections inviting lesser punishment i.e. Section 279/304A IPC and since the accused were drunk and the accident was caused in a rash and negligent manner, other sections would need to be added. He submits that the case ought to have been registered under Section 304-II IPC.

Issue notice.

Ms. Kamna Vohra, the learned Additional Standing Counsel (Crl.) accepts notice on behalf of the State and submits that the case has since been

transferred from Police Station Shalimar Bagh to MACT Cell, District North West.

The learned counsel appearing on behalf of the parties have no objection if this writ petition is to be treated as a representation to the said investigating agency to re-look in the matter. In the facts and circumstances of the case, this petition shall be treated as a representation of the petitioner to the police to look into her grievance comprehensively.

A decision in this regard shall be taken by the police within four weeks from today.

Should the petitioner have any grievance thereafter, it will be open to her to seek judicial remedies, as may be available in law.
