O R D E R

% 09.11.2017 Petitioner was convicted under Section of the Negotiable Instruments Act, 1881 (for short, 'the Act'). Appeal has been dismissed.

Petitioner has preferred present revision against his conviction as well as sentenced handed down to him under Section 138 of the Act. It is submitted that petitioner and respondent no.2 have now settled the matter amicably. In terms of the settlement, petitioner has paid `1.60 lacs to the respondent no.2 vide a demand draft, photocopy whereof has been placed on record. Respondent no. 2 has accepted the settled amount. It is prayed that offence under Section 138 of the Act may be permitted to be compounded in view of the settlement.

Keeping in view that a settlement has been arrived at between the petitioner and respondent no.2, inasmuch as, settled amount has been paid to the complainant, offence under Section 138 of the Act is permitted to be

compounded and impugned judgment as well as order are set aside. Petitioner be released from the jail, if not required in any other case. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
