O R D E R

% 06.10.2016 Present execution petition has been filed by the decree holders seeking execution of the decree dated 29.4.2015 passed in CS(OS) No.1714/2011. On 26.4.2011, this Court had observed that the parties would jointly identify a contract who would build the wall in terms of compromise decree. The parties agreed that the wall between points W1 and W2, which was built by judgment debtor no.3, was to be removed and a fresh wall between the points W3 and W4 was to be erected. It was also agreed that the cost of erecting the wall and removal of malba would be shared equally between the parties. On 30.9.2016 judgment debtors stated that the entire wall was not demolished by the decree holders while the decree holders submitted that the entire wall was demolished.

Both counsel for the parties had agreed to visit the property in question and file a joint report. A joint inspection report has been handed over by the counsel for the parties in court today as per which a new wall has been erected between points W3 and W4. Let the joint report be taken on record. Counsel for the parties submits that no further orders are required to be passed in the execution petition as the partition wall stands erected, all disputes between the parties stand settled.
