% 05.02.2018 By this petition the petitioner challenges the communication dated 23rd October, 2017 declining to grant parole to the petitioner which he had sought on the ground that he has to arrange funds for the livelihood of his family, admit his sons in the school by depositing fee and re-establish social ties.

A status report has been filed by the State as per which the family of the petitioner comprising of his wife and four children are residing at 2/1310, J.J. Colony, Madan Pur Khadar, PS Jaitpur. Further as per the nominal roll the petitioner was granted regular bail during the course of trial and regular suspension of sentence during the pendency of the appeal. Out of the sentence of imprisonment for a period of four years and a fine of ₹3000/- the petitioner has already undergone nearly two years sentence including remissions.

W.P.(CRL) 3238/2017

Considering the verification report and the nominal roll this Court deems it fit to grant parole to the petitioner. It is therefore directed that the petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount to the satisfaction of the Superintendent Tihar Jail. Petition is disposed of.

Copy of this order be communicated to the petitioner through Superintendent Tihar Jail.
