% 01.08.2016 Present FIR No. 110/2015 under Section 420 IPC was registered at Police Station Crime Branch on the complaint of respondent no. 2. Respondent no. 2 alleged in the FIR that petitioner had induced him to invest money in some properties, since property rates in Delhi were increasing by leaps and bounds. Respondent no. 2 has alleged that he had given `1,65,00,000/- and `37 lacs to the petitioner on two occasions. Petitioner gave some property papers to him but on enquiry, it was revealed that value of those properties was meagre. When petitioner was confronted with this fact he gave `16,00,000/- to respondent no.2. However, remaining
amount was not returned.
Petitioner and respondent no. 2 have now settled their disputes vide Settlement Deed dated 17th May, 2016. They have settled their disputes for `37,00,000/-.
Respondent no. 2 admits having received entire settled amount from the petitioner. Photocopy of the pay order has been placed on record. It may be noted that investigations are still pending. Learned counsel for the petitioner, on instructions, submits that petitioner has also filed one complaint against respondent no. 2 in the Police Station Shahjahanabad, Bhopal, Madhya Pradesh and the said complaint will be withdrawn by the petitioner, inasmuch as no other complaint is pending in any Court of law.
Keeping in mind that parties have settled their disputes and respondent no.2 does not want to pursue the FIR any further, FIR No. 110/2015 under Section 420 IPC registered at Police Station Crime Branch and the consequent proceedings emanating therefrom are quashed. Petitioner shall withdraw the aforesaid complaint within four weeks. Writ petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J.
