Learned counsel for the appellant states that notwithstanding various prayers made in the appeal and the grounds urged therein, she has been instructed by the appellant to make a statement to this Court that if the plaintiffs of CS(OS) No.176/2015 agree that the learned Single Judge would decide the application filed by the appellant under Section 8 of the Arbitration and Conciliation Act, 1996, the appellant would have no grievance to the impugned order.

Learned counsel for respondents No.1 to 81, who are the plaintiffs in the suit, says that the plaintiffs have no objection if it is observed that on the next date of hearing the learned Single Judge should hear arguments in FAO(OS) 554/2015
the application filed by the appellant under Section 8 of the Arbitration and Conciliation Act, 1996.

The instant appeal is accordingly disposed of without adjudicating the issue urged in the appeal for aforenoted reasons. We would expect the learned Single Judge to expeditiously decide IA No.14310/2015 filed by the appellant under Section 5 read with Section 8 of the Arbitration and Conciliation Act, 1996.
