% 04.12.2017 The instant petition has been filed by the petitioners seeking quashing of FIR No.345/2009 under Sections 452/323/324/341/354/506/34 IPC registered at Police Station - Mandawali Fazalpur, Delhi on the complaint of respondent No.2 and the proceedings pursuant thereto on the ground that the parties have amicably settled their disputes. Respondent Nos.2 and 3 are present in Court today and are identified by the Investigating Officer and their counsel. They state that they have settled the matter with the petitioners with their own free will and choice without any threat, pressure and coercion as per Compromise Deed dated 27.01.2017 and they do not wish to pursue the abovementioned FIR and the proceedings pursuant thereto.
Statements of the parties have been recorded separately. In view of the fact that the parties have amicably resolved their differences voluntarily out of their own free will and without any coercion, CRL.M.C. 5072/2017
pressure, and no useful purpose will be served in continuance of the proceedings. It would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. Consequently, FIR No.345/2009 under Sections 452/323/324/341/354/506/34 IPC registered at Police Station - Mandawali Fazalpur, Delhi and all the proceedings pursuant thereto are hereby quashed.
The petitioner is, however, burdened with cost of Rs.5,000/- to be deposited with the Prime Minister National Relief Fund. Cost deposited. A copy of receipt of cost of Rs.5000/- is taken on record. The petition is disposed of.
