versus THE STATE GOVT OF NCT OF DELHI & ORS..... Respondents Through:

Mr. Izhar Ahmad, APP for State with W/SI Rishali Yadav, P.S.

Tilak Nagar.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 20.09.2018 Notice. Learned APP accepts notice for respondent no. 1. Respondent nos.2 and 3 are present in Court along with their counsel, who accepts notice. They have been identified by W/SI Rishali Yadav of police station Tilak Nagar.

It is submitted that petitioner and respondent no.2 are neighbours. Respondent no.2 is mother of respondent no.3. Present FIR No. 340/2016 under Sections 354(A)/506 IPC and Section 12 of The Protection of Children from Sexual Offence Act, 2012 was registered against petitioner at police station Tilak Nagar, on the complaint of respondent no.2. With the intervention of their common friends and other family members, petitioner

and respondent nos.2 and 3 have settled their disputes amicably, inasmuch as, petitioner has compensated respondent no.3 by paying `30,000/- vide a demand draft, photocopy whereof has been placed on record. Respondent nos. 2 and 3 submit that they have settled the matter with petitioner of their own free will and without any undue force, pressure or coercion. They have no objection in case aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Keeping in mind that petitioner and respondent nos. 2 and 3 are neighbours and they have settled their disputes voluntarily in order to maintain harmonious relations with each other in future, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.

A.K. PATHAK, J.
