O R D E R

% 20.11.2018 1.The only question in the present case is whether the Petitioners' prayer for declaration that the land acquisition proceedings in respect of land admeasuring 6 bighas and 12 biswas in the revenue estate of Village Satbari falling in Khasra No.1087 has lapsed as a result of Section 24(2) of the Right to Fair Compensation and Transparency in Land Acquisitions, Rehabilitation and resettlement Act 2013 should be granted?

2. In the counter affidavit filed, the stand taken by the LAC is that not only has the compensation been paid but the physical possession has also been taken of the land.

3. To satisfy ourselves, we have perused the original record i.e. the W.P.(C) 9275/2015 Page 1 of 2

'Statement - A' which is prepared at the time of making payment. There are entries at page 41 of the Statement-A in respect of the award No.14/198788, which shows that compensation has been paid to Mr Dalpat and by way of corrigendum, compensation was paid to Santosh Kumari, Prithviraj, Kalawati and Dinesh Gupta. The compensation amount determined to be payable to Dalpat isto Rs.3,91,763.80.

4. Since the Court is satisfied about the payment of compensation, no further orders are called for particularly, since the Petitioner did not dispute that the physical possession is no longer with him.

5. The petition is accordingly dismissed.
