% 09.02.2017 The present suit has been filed for partition of 1/4th undivided share of a residential property bearing no. 6/52, WEA, Karol Bagh, Delhi - 110005.
On the request of parties, the matter was referred to the Mediation Centre wherein all the parties, who are joint owners, have settled their dispute. Settlement agreement dated 04.11.2016 has been placed on record. Two Special Power of Attorney duly executed by Mrs. Krishna Malhotra (defendant no.2), Ms. Renu Chopra (defendant no.3), Mr. Ajay Kumar Malhotra (defendant no.4), Mrs. Divya Arora (defendant no.6) & Mrs. Apurva Malhotra Kapoor (defendant no.7) are hereby annexed as Annexure 'A' (collectively) and Annexure 'B' (collectively) to the Settlement Agreement.
Since the matter stands settled between the parties, the suit stands decreed in favour of the parties in terms of settlement. A decree sheet be prepared in terms of the Settlement Agreement. As the matter stands settled before the Mediation Centre before the filing of the written statement, in terms of Section 16A of the Court Fees Act read with Section 89 of CPC, court fee be refunded to the plaintiff.
