% 14.09.2018 Learned counsel for the plaintiff states that the parties have settled the matter and the plaintiff has received the principle amount. He submits that he would like to withdraw the present suit.

Suit is accordingly dismissed as withdrawn. In terms of judgment of this court in J.K.Gorgings vs. Essar Construction India Ltd. & Ors., (2009) 113 DRJ 612 the plaintiff shall be entitled to refund of the Court Fees.
