The present petition has been filed under Section 482 Cr.P.C. by the petitioner against the entire proceedings of FIR/RC No.AC-1 2013 A 0003/CBI/AC-1/New Delhi including the order dated 30.07.2015 passed by the Court below.
Vide order dated 30.07.2015, the Court below dismissed the application of the petitioner under Section 91 of the Cr.P.C.. During the course of arguments, it was revealed that the case of the petitioner is that he has been provided with CD of 155 call details.
Learned Special PP for CBI has submitted that the SP, CBI was asked to furnish the relevant call details and he has stated that CD of only 155 call details were available with the Investigating Officer and no other call detail is available with him.
In the facts and circumstances mentioned above, the counsel for the petitioner wishes to withdraw the present petition with the liberty to move an application before the Trial Court under Section 91 of the Cr.P.C. for issuance of directions for production of documents called for from the relevant person having the possession or power of the documents.
I order accordingly.
