Learned counsel for the petitioner submitted that the petitioner is not disputing over the payment of compensation awarded in the impugned order, however, he is having grievances about certain observations regarding the income of the petitioner. 2.

It is clarified that while disposing of the interim maintenance application as well as the appeal, as is apparent the observations made in the impugned orders by the concerned Courts are only prima facie observations and none of the observations made in the impugned orders would tantamount to final expression on the merits of the petition pending before the Trial Court and would not be taken into

consideration for the purpose of the final adjudication of the petition by the Trial Court pending before it. The Trial Court, at the time of final adjudication of the petition, shall decide the same on the basis of material in the case, as per law. Hence, no notice is required to be issued to the respondent.

In view of the aforesaid observation, learned counsel for the petitioner submitted that she may be allowed to withdraw the present petition. Accordingly, the present petition is dismissed as withdrawn. CRL.M.A. 49805/2018 is also dismissed as withdrawn. CHANDER SHEKHAR, J DECEMBER 17, 2018/rk
