The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.62/2013 registered under Sections 392/394/34 IPC at PS Mianwali Nagar. Status report is on record.

I have heard the learned counsel for the parties. Petitioner's counsel urged that the petitioner is in custody since 29.03.2013. The complainant has not identified him. The petitioner declined to participate in the TIP as the police had obtained his remand for certain days and his photographs were shown to the witnesses. No material article has been recovered from his possession. Learned Addl. Public Prosecutor urged that there are serious allegations against the petitioner and his associates. The petitioner was identified by the complainant in the Court.

The petitioner along with his associates is facing trial for commission of offences under Sections 392/394/34 IPC whereby the complainant was robbed of his bag containing `7 lacs, 2 pen drives, 1 BAIL APPLN. 2120/2015

memory card, 4 ATM cards, A/C register and other documents. On resistance, he was manhandled and given a fist blow on his nose. Status report reveals that on 29.03.2013, the petitioner was arrested from Amritsar and during police remand, he recovered pass-book of Union Bank, Tata Indicom bill, two invoice bills receipt and `25,000/-. He declined to participate in the TIP proceedings. The complainant in his Court statement identified him to be one of the assailants. Out of seventeen witnesses, thirteen witnesses have already been examined.

Considering the gravity of the offences, I find no sufficient ground for grant of bail and it is dismissed. S.P.GARG, J JANUARY 22, 2016 / tr BAIL APPLN. 2120/2015
