% 04.04.2018 This petition has been filed by the petitioner under Section 15 of the Arbitration & Conciliation Act, 1996 (hereinafter referred to as the 'Act') seeking substitution of the Arbitrator who had been appointed for adjudicating the disputes that had arisen between the parties. The Arbitrator appointed by this Court vide order dated 25.02.2015 has tendered his resignation due to his ill-health. Learned counsel for the respondent has no objection to a substitute Arbitrator being appointed by this Court or by Delhi International Arbitration Centre (DIAC) Parties are therefore, directed to appear before DIAC on 23rd April, 2018 at 2.00 p.m. DIAC shall appoint the substitute Arbitrator for adjudicating the disputes that have arisen between the parties and are pending adjudication in arbitration case reference no.DAC/809/03-15. The substitute Arbitrator shall conduct the proceedings from the stage the arbitration proceedings was before the earlier arbitrator.

The petition is allowed with the above directions. Dasti.
