% 27.08.2018 By the present petition the petitioner seeks quashing of FIR No. 220/2016 under Sections 385/451/506/507 IPC registered at PS Shalimar Bagh, Delhi on the complaint of Respondent No.2 and the proceedings pursuant thereto on the ground that the parties have settled the matter. Learned proxy counsel for Additional Standing Counsel for the State on instructions submits that the above noted FIR was registered on the complaint of respondent No. 2 when the petitioner while working as a legal associate with the L&T Co. visited the residence of respondent No. 2 as talks of compromise had been initiated between the parties and respondent No. 2 lodged the above noted FIR alleging threat by the petitioner.
Respondent No. 2 who is present in Court and is identified by the learned counsel and Investigating Officer states that the above noted FIR was registered in a misconception as she did not know that talks of settlement had been initiated between the parties and it is in this direction that the petitioner i.e. Dharmendra @ Dharmendra Singh, had visited the premises of the respondent No. 2 which she mistook as a threat. Respondent No. 2 states that since she has now settled with the petitioner vide the settlement deed dated 2nd November, 2017, copy whereof is annexed as Annexure-P2 of the paper book, she does not want to pursue the abovementioned FIR and the proceedings pursuant thereto. She further undertakes to abide by the terms of settlement arrived at between the parties. Petitioner who is present in Court and is identified by the learned counsel affirms the statement of respondent No.2 and undertakes to abide by the terms of settlement arrived at between the parties vide the settlement deed dated 2nd November, 2017.
In view of the fact that the parties have amicably resolved their differences of their own free will, volition and without any coercion and no useful purpose will be served in continuance of the proceedings, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
Consequently, FIR No. 220/2016 under Sections 385/451/506/507 IPC registered at PS Shalimar Bagh, Delhi and proceedings pursuant thereto are hereby quashed.
Parties have signed this order sheet in acknowledgment of their statements made before this Court.
Petition is disposed of.
