CONT.CAS(C) 758/2017 The Contempt Petition has been filed by the petitioner alleging noncompliance of the statement made by the respondent before Principal Judge, Family Court on April 12, 2014, inasmuch as, he along with the petitioner herein shall file petition for divorce by way of mutual consent. It is a conceded position of the parties that they have moved a first motion before the Family Court. It appears that the respondent did not come forward in filing the second motion.

The learned counsel for the respondent submits that the respondent was under the impression that divorce has been effected. In any case, he states that the respondent shall approach the petitioner for filing the second motion before the concerned Court within one week from today. Learned counsel for the petitioner states, the aforesaid shall satisfy the grievance of the petitioner in this petition.

Taking the statement made by the counsel for the respondent, on record, the petition is disposed of as such.
