% 08.02.2018 Vide the present petition, the petitioners had sought quashing of the FIR, PS Anand Parvat registered under Sections 498A/406/34 of the Indian Penal Code, 1860 on the basis of a stated settlement arrived at between the petitioners and the respondent no. 2 submitting to the effect that there were no grievances left inter se and as per averments made in the settlement document dated 30.03.2017 arrived at Delhi Mediation & Conciliation Centre, Tis Hazari Courts, the parties had agreed to live together.
Vide proceedings dated 13.12.2017, notice of the petition was directed to be issued to the respondent no. 2, in view of the submission made on behalf of the petitioners that the respondent no. 2 was not co-operating and a verification report was called for in
relation to the aspect as to whether the petitioner no. 1 and the respondent no. 2 were living together qua which a verification report has been submitted now on behalf of the State under the signatures of the SHO, PS Anand Parvat who is stated to be Insp. Malkiet Singh by SI Vidyakar Pathak, which report is to the effect that the petitioner no. 1 and the respondent no. 2 are not living together. The respondent no. 2 in person also submits that she is not living with the petitioner no. 1 and that she opposes the prayer made by the petitioners seeking quashing of the FIR. Learned counsel for the petitioners, at this stage seeks permission to withdraw the present petition.
