benefits under the Flexible Complementing Scheme with a further direction that in case, the respondents are found fit, they be paid all consequential benefits.

2. The record shows that the primary ground on which the petitioners had approached this Court was that the issue raised in the present petition is pending consideration before the Apex Court, by way of Civil Appeal No.6359/2016 titled Union of India & Ors. v. Vinay Kumar. It is the common case of the parties that the said appeal stands dismissed by the Apex Court on 25.08.2021.

3. In the light of the aforesaid, once the issue stands conclusively decided by the Apex Court, we find absolutely no reason to interfere with the impugned orders passed by the learned Tribunal.
