% 28.11.2017 The petitioner seeks a direction that section 408 IPC be dropped from the FIR No. 202/2016 registered at P.S. Timarpur, Delhi. Ms. Nandita Rao, the learned counsel for the State states upon instructions from the Investigating Officer who is present in the Court, that case was registered under Section498A/406/34 IPC and inadvertently in the notice to the petitioner, section 408 was mentioned. In the circumstances, the FIR (as annexed at page 25 of the petition) shall be read as being registered under section 498A/406/34 IPC.

Ms. Nandita Rao further states upon instructions that the
