By way of this writ petition filed under Article 226 of the Constitution of India, petitioners are seeking protection to their life and property from the malafide acts of respondent No.2.

Status report has been filed by the State wherein it is stated that enquiries were made from the respondent No.2, who stated that petitioner Ganesh Bahadur is his tenant and took ₹10 lakh loan from him. An agreement was also entered into between the parties but since the period of agreement has been expired, the petitioner is neither returning the money nor paying the rent.

Mr.Sanjay Lao, ASC for the State submits that though as per status report at present there is no element of threat to petitioners, still State is ready to provide protection to the petitioners through Beat Staff in future, if W.P.(CRL) 3150/2017

there is any element of threat to them from the respondents No.2. It is further stated on behalf of State that the mobile number of the beat constable has been provided to the petitioner No.1 to enable him to contact to beat officer and division officer in case of need. 4.

In view of the aforesaid assurance given by the State, learned counsel for the petitioners seeks permission to withdraw this writ petition. 5.

The writ petition is dismissed as withdrawn.
