O R D E R

% 22.01.2018 The present petition has been filed under Section 11 of the Arbitration and Conciliation Act, 1996 seeking appointment of an Arbitrator for adjudicating the disputes that have arisen between the parties in relation to the contract for installation/ purchase of mist collector for the plant of the petitioner.

The respondent, though has filed its reply to the petition, submits that it has no objection if the parties are referred to the Delhi International Arbitration Centre, (DIAC), who may appoint a Retired Additional District Judge as the Sole Arbitrator to adjudicate the disputes that have arisen between the parties. The said proposal is acceptable even to the counsel for the petitioner. In view of the above, the parties are directed to appear before the DIAC on 2nd February, 2018 at 3.00 p.m.

The DIAC shall appoint a Sole Arbitrator for adjudicating the

disputes that have arisen between the parties. The arbitration and the fee shall be governed by the DIAC Rules.

The petition is allowed in the above terms.
