CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 23.08.2018 Respondent no.2-Ms. Preeti Sharma is present in Court along with her counsel and has been identified by SI Deepak of police station Vikas Puri. Respondent no.2 submits that she has settled the matter with petitioner no.1 of her own free will and without any undue force, pressure or coercion in terms of Memorandum of Understanding dated 15th February, 2017. She further states that her marriage with petitioner no.1 has already been dissolved by a decree of divorce by mutual consent dated 3rd October, 2017 passed by Family Court, South-West District, Dwarka, Delhi. Petitioner no.1 has paid `1 lakh to respondent no.1 in the court today vide a demand draft, photocopy whereof has been placed on record. Respondent no. 2 submits that with this payment, entire settled amount stands received by her and she is not willing to pursue criminal proceedings any

further and she has no objection in case FIR no. 518/2015 under Sections 498-A/406/34 IPC registered at police station Vikas Puri and consequent proceedings emanating therefrom are quashed against the petitioner no.1 and his relative, that is, petitioner no. 2.

Keeping in mind the settlement arrived at between the petitioner no.1 and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, the aforesaid and consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.
