The petitioners have filed the present petition, inter alia, praying that respondents be directed to forthwith provide the entire phone call details of both outgoing and incoming calls of petitioner no.1 mobile phone from January 2010 to November 2017. The petitioners claim that such details are necessary in order for the petitioners to pursue the application in a disposed of suit CS(OS) 519/2010.

Respondent no.1 is not a State within the meaning of Article 12 of the Constitution of India; it is a service provider and, therefore, this Court does not consider it apposite to entertain such relief against respondents. Needless to state that if there is a procedure prescribed for customers to obtain their phone records from the service provider, respondent no.1 shall duly entertain a request in this regard as per the procedure established. 3.
The petition is disposed of.
