Petitioner seeks quashing of FIR No.753/2016 under Sections 323/341/506 IPC, Police Station Shalimar Bagh. 2.

Subject FIR was registered, consequent to a quarrel, which took place between the students of the same School. 3.

Petitioner along with the other two co-accused, were arrayed as accused in the subject FIR. Learned counsels for the petitioner submits that the two other co-accused have already been discharged by the Juvenile Justice Board.

Parties had been referred to Mediation. With the assistance of the Mediator, the parties have settled their dispute and Settlement Agreement dated 21.02.2018 has been executed.

Petitioner had appeared personally on 11.05.2018 and was granted exemption from personal appearance. His father is present today in Court in person to represent him.

The complainant/Respondent No.2 is present in Court in person and is represented by the counsel and is identified by the Investigating Officer. He confirms that parties have arrived at a Settlement and further submits that he does not wish to press his complaint any further. 7.

Keeping in view the Settlement as well as the age of the petitioner and the fact that the dispute had occurred between the school students, and Settlement Agreement dated 21.02.2018 has been executed before the Mediation and further respondent No.2 does not wish to press his complaint, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating there from. 8.

Accordingly FIR No.753/2016 under Sections 323/341/506 IPC, Police Station Shalimar Bagh and the consequent proceedings emanating there from are accordingly quashed.
