% 16.11.2017 Issue notice. Mr. Mehra accepts notice on behalf of the State. The status report tendered in court is taken on record. The petitioner has preferred the present writ petition to seek the writ of habeas corpus to produce his wife Shiksha Jain, d/o. Sh. Praveen Jain. According to the petitioner, he had married Shiksha on 14.02.2017 as per Hindu rites and customs. He claims that after the marriage, his wife had returned to her parental home. According to him, the parents of Shiksha are not permitting her to join the petitioner.
Shiksha is present in Court since she has been produced. We have interacted with both the petitioner and Shiksha in chamber. Shiksha states that she does not wish to reside with the petitioner and that she is living with her parents out of her own free will and accord. In these circumstances, since Shiksha is major and is living with her parents out of her own free will and accord, no relief can be granted to the petitioner. The petition is, accordingly, dismissed.
