Learned proxy counsel for the Petitioner submits that the local counsel is in Ajamgarh. The main counsel has died. He has been requested to seek an adjournment.

The record shows that the Criminal Petitions have been filed to challenge the Order on Charge dated 31.08.2016 framed by the learned CMM, New Delhi in FIR No. 24/2009 in CRL.M.C. 5029/2017 and FIR No.140/2009 in CRL.M.C. 5030/2017. This Order was challenged before the Learned ASJ in CR. No. 29/2017 in CRL.M.C. 5029/2017 and CR. Learned APP for the State, submits that aside from taking adjournments here, the Accused are also stalking the trial, before the learned Trial court.

Considering the consistent adjournments being sought, it is evident that the Petitioner is not interested in prosecuting the present Petitions, as well as, the Applications, which are hereby dismissed for non-prosecution.
