O R D E R

% 23.02.2018 Vide the present petition the petitioner has prayed for quashing of the decision taken by respondent no.2 in its 272nd meeting held on 06/07.07.2017, whereby the respondent no.2 has not accorded approval to the petitioner's application for grant of recognition for the course of B.El.Ed on the ground that the faculty appointed by the petitioner does not hold the qualification of NET/Ph.D., which is mandatory as per the NCTE recognition norms dated 29.05.2017 notified on 09.06.2017.

Learned counsel for the petitioner submits that the faculty was appointed before issuance of the notification and, therefore, there is no infirmity in the decision of the petitioner to appoint those persons who were not holding the qualification of NET/Ph.D. However, after some arguments, the learned counsel for the petitioner concedes that

neither the requisite documents to support his aforesaid plea have been filed nor the affiliated body has been impleaded. He, therefore, seeks leave of the Court to withdraw the present petition, with liberty to file a fresh substantive petition to take all grounds as deemed fit, including the grounds taken in this petition. The aforesaid request is not opposed by the learned counsel for the respondents.

The leave as prayed for is granted and the petition is dismissed as withdrawn with the aforesaid liberty.
