% 30.10.2018 Learned counsel for the petitioner submits that petitioner and prosecutrix were in a relationship.
After their relationship broke off prosecutrix filed the present FIR under Sections 323/376/377 IPC against the petitioner. Prosecutrix has falsely alleged that petitioner had developed physical relations with her on the pretext of marrying her. It is further submitted that petitioner has already handed over his mobile phone to the Investigating Officer during the investigation. Learned APP submits that petitioner has joined the investigation and his mobile phone has been sent to FSL for retrieving the deleted data. Keeping in mind totality of the facts and circumstances of this case, it is ordered that in case of arrest petitioner be released on bail, subject to his
furnishing a personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of Arresting Officer/Investigating Officer/SHO of the concerned police station.
Bail application is disposed of in the above terms. Dasti.
