% 15.11.2017 Petitioner is aggrieved by the fact that that the election of the Indian Federation of Small and Medium Newspapers is scheduled for today. His submission is that this would be a wholly illegal exercise. He being the Secretary General has been duly elected up to the year 2019 and this midway election is a wholly arbitrary exercise; it should be stopped.
On advance notice, learned counsel for respondent no.1/Registrar of Societies has put in his appearance. Respondent no.2 is the Returning Officer.
Record shows that on 05.10.2017 a letter has been issued by the petitioner federation to respondent no.2 informing him that such an exercise should not be carried out. Learned counsel for the respondent rightly points out that since the voting is scheduled for
today it may not be proper to stop the election at this stage especially keeping in view the fact that the petitioner was aware of this election way back on 05.10.2017.
After some arguments, learned counsel for the petitioner seeks permission of this Court to withdraw this petition. Petition is dismissed as withdrawn. Liberty is granted to the petitioner to challenge the election once result is declared. INDERMEET KAUR, J NOVEMBER 15, 2017 ndn
