After arguments, this appeal is disposed of as not pressed as the appellant has already filed a Regular First Appeal under Section 96 CPC being RFA No. 931/2017 against the final judgment on merits dated 13.1.2017 and in that RFA it need not be againsaid that the appellant herein and who is also the appellant in the said RFA 931/2017 will have all rights to urge all issues of facts and law in terms of the record of the trial court for questioning the judgment dated 13.1.2017.
