% 16.11.2017 A submission has been made on behalf of the petitioner that the applicant has been falsely implicated in the present case as a counter blast to the FIR No. 1068/17 registered at Police Station New Usmanpur that has been registered on the basis of the complaint of the wife of the applicant.
Learned counsel for the complainant submits that a settlement has been arrived at between the parties and that the petitioner has sought to violate the same.
Learned APP for the State opposes the prayer made by the applicant seeking grant of anticipatory bail submitting to the effect that there are allegations of molestation of the wife of the complainant in the FIR.
Without any observation on the merits or demerits of the both the FIRs as it is apparent that both the FIRs relate to allegations of
alleged molestation made by either side, the submission that has been made by the parties that there had been a settlement between the parties and that the petition seeking quashing of FIR No.1068/2017 and 1066/2017 are listed for 23rd November, 2017 and as in reply to a specific court query, it is informed by the Investigating Officer of the case that there are no previous antecedents against the applicant, taking the totality and circumstances into account, the applicant, in the event of arrest, is allowed to be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial court with the direction that he shall join the investigation as and when required and shall not leave the country without the permission of the Court.
