% 15.11.2017 Vide the present petition, the two petitioners i.e. Amit Sharma s/o Sh. Balkishan Sharma and Jitendra Singh @ Jeetu s/o Sh. Banwari Singh seek quashing of FIR no. 604/2014 registered at PS Kalyan Puri under Sections 392/394/397/411/34 Indian Penal Code, 1860.
Both the petitioners and the respondent no. 2 are present in the court and have been duly identified by the IO of the case, submitting inter alia to the effect that a settlement has been arrived at between them. Learned counsel for the petitioner has submitted that the respondent no. 2 has been adequately compensated by the petitioner and in order to keep peace, harmony and good relations between the parties, the petitioners seek quashing of the FIR.
Respondent no. 2 has produced his original Aadhar Card no.
780965705702, photocopy of which is Ex.CW2/A (original seen and returned). Inter alia, the respondent no. 2 has identified his signatures on the Compromise Deed dated 02.11.2017 at point-A Ex.CW2/B. Taking into account the factum that there are no previous adverse antecedents against the petitioners and the fact that the petitioners and the respondent no. 2 have categorically submitted that they have arrived at an amicable settlement through the Compromise Deed voluntarily due to the intervention of the respectable and responsible members and well wishers of their society and as the learned APP for the State also in the present circumstances does not oppose the prayer made by the petitioners, in view of the said settlement arrived at between the parties and as an amicable settlement through the Compromise Deed dated 02.11.2017 Ex.
CW2/B, it would be appropriate in the interest of justice that the prayer made by the petitioners seeking quashing of FIR no. 604/2014 registered at PS Kalyan Puri under Sections 392/394/397/411/34 Indian Penal Code, 1860 and all consequential proceedings emanating therefrom are quashed, which are thus accordingly quashed.
The petition is disposed of.
