The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.879/2014 registered under Sections 363/366/376 IPC read with Section 4 POCSO Act at PS Tilak Nagar. Status report is on record.

I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 16.08.2014. Charge-sheet has since been filed upon completion of the investigation. The prosecutrix and the petitioner were acquainted with each other for the last about three years and they intended to marry. Both of them had left the house without informing victim's parents. They had travelled to Kanpur by bus. Apparently, the victim was a consenting party at that time. In her 164 Cr.P.C. statement, she even stated to have performed marriage in a temple at Kanpur. She did not level any allegation of rape in her 164 Cr.P.C. statement. BAIL APPLN. 2092/2015

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the Trial Court.

The bail application stands disposed of.
