% 30.01.2020 Mr. Janak Chand-the petitioner in W.P.(C) 10087/2017 has since passed away; his wife seeks release of the monies already lying deposited before this Court by the respondent in settlement of all claims. The learned counsel for the respondent states upon instructions that should the same lead to closure of the case, he would have no difficulty in
releasing the said amount, alongwith interest accrued thereon, to the widow of Mr. Janak Chand.
In view of the above, let the monies lying deposited, be released to the widow of the petitioner-Ms. Raksha Devi in settlement of all the petitioner's claims.
However, the Court would note that the petition has been pending before this Court since past three years. In addition, the respondent itself has filed a writ petition challenging the award. Surely, the widow must have expended some monies towards litigation costs. In the circumstances, for a fine closure, let Rs. 25,000/- be paid to the widow of Mr. Janak Chand towards litigation costs for both the cases.
Let Rs. 25,000/- be deposited directly into the bank account of Ms. Raksha Devi, bearing account no. 602210110007405, IFSC- BKID0006022, Branch- Panchsheel, Bank of India, New Delhi, within a period of two weeks from the date of receipt of copy of this order. The petitions, alongwith pending application, are disposed-off in terms of the above.
