The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.452/2015 registered under Sections 406/420/34 IPC at PS Gandhi Nagar. Status report is on record.

During the course of arguments, learned counsel for the petitioner on instructions volunteered to pay `2 lacs to the complainant within fifteen days without prejudice and subject to future adjustment (if any).

It is informed that co-accused Lalit was granted anticipatory bail on his paying `4 lacs to the complainant. Petitioner's counsel urged that only `1.40 lacs were received by him in the transaction and he is ready and willing to return it to the complainant. BAIL APPLN. 2097/2015

Considering the facts and circumstances of the case and the offer of the petitioner to pay `2 lacs to the complainant, the petitioner is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer with the condition that he shall pay `2 lacs to the complainant without prejudice and subject to future adjustment (if any) within fifteen days through the Investigating Officer by way of bank draft. In case of non-compliance of the order, the complainant / State will be at liberty to move this Court.

The petitioner shall join the investigation as and when required. At first instance, he shall appear before the Investigating Officer on 27.01.2016 at 03.00 p.m.

The bail application stands disposed of.
