Meena Kumari, sister of the petitioner is present in Court. She is residing in Faridabad. The address of the sister of the petitioner has since been verified. She also reiterates that the petitioner surrendered late by one day in 2014 and in March, 2015, he was released and could not surrender in time because their elder sister Dulari Devi was seriously ill and the petitioner was looking after her at the village. Petitioner was re-arrested on 11th March, 2016 and Dulari Devi died on 15th March, 2016. 2.

On a further query raised by this Court, Meena Kumar fairly admits that Dulari Devi was having a family, that is, six children, out of which two girls are now married, her husband is also earning but staying separately due to work.

Considering the fact that sister of the petitioner Meena Kumar is willing to stand surety for the petitioner and the last time when the petitioner was released, he did not surrender due to the ailment of his sister, this Court deems it fit to give another chance to the petitioner but with stringent conditions.

It is, therefore, directed that the petitioner be released on parole for a period of four weeks, from the date of his release on his furnishing a personal bond in the sum of ₹50,000/- with one surety of the like amount, which surety would be of the sister of the petitioner, that is, Meena Kumari, further subject to the condition that during the period of parole the mobile phone of Meena Kumari will be kept in active mode so that the petitioner can be contacted from her mobile phone. During the period of parole, the petitioner will report to PS Ambedkar Nagar on every Monday at 4.00 PM. 5.

Petition is disposed of.

Copy of the order be communicated to the petitioner through Superintendent, Mandoli Jail.
