% 21.01.2019 The dispute in the present petition is that the petitioner's eatery has been sealed by the respondent on the ground that it was functioning in unsanitary and unhygienic conditions. Counsel appearing for the petitioners states that petitioner No. 1 now has a Health Trade License dated 16.11.2018, which would entitle him to run his eatery.

Learned counsel appearing for the respondent submits that if on the basis of the Health Trade License now available, the petitioners were to apply to the Deputy Commissioner (City Shahdara-Paharganj Zone) of the North Delhi Municipal Corporation, the Deputy Commissioner would consider such application in accordance with law. Counsel for the petitioners submits that on the basis of the statement

made by the respondent, the petition may be disposed of, putting the respondent to a timeline within which to process the petitioner's application for de-sealing.

Accordingly, the present petition is disposed of with the direction that the respondent shall consider and dispose of the petitioner's application for de-sealing of his premises within two weeks of his making such application to the concerned officer as mentioned in this order. The present petition and application are disposed of in the above terms.
